What do I do now?
Now that you have qualified for a FREE Home Visit it is important that you have thought about the following and have all the relevant information to hand. You should also take this opportunity to discuss all aspects of your Estate Management with your Consultant.
Executors - In your Will you have to appoint Executors to carry out your wishes in dealing with your estate. Being an Executor of a Will can be difficult especially when you are dealing with the loss of a loved one. It has legal, financial and tax consequences. Executors are personally liable for the deceased's obligations and may have to apply for Probate. Trustees - When you die your property, which includes all assets, can be placed into a trust for a beneficiary. The Trustees are the legal owners of the trust and are legally bound to look after the property in the trust in a particular way and for a particular purpose. Trustees administer the trust and in certain circumstances make decisions about how the property in the trust is to be used. The trust can continue even though the Trustees may change, but there must usually be at least one trustee. If you are placing property into a trust you will need to give consideration as to whom you want to appoint as your Trustees.
Guardians - If you have dependants you will need to think about who will care for them if you are no longer around. Under normal circumstances it would be the surviving parent of the child who takes on that responsibility. However if you are an un-married couple and have children you need to ensure both parents have Parental Responsibility. You can also choose to appoint more than one guardian.
Beneficiaries - These are the people who will benefit from your estate. Your Consultant will need the full names of any beneficiary: you could also name a favourite charity. Your beneficiaries can also benefit from property held in Trust for them.
You should also consider a Protective Property Trust should your surviving partner be taken into care. It is simple to do and can save you thousands of pounds.
During the home visit your Consultant will discuss important issues regarding your estate, so it is vital that you have thought about the value of your assets including second properties, cars, jewellery, household contents and the value of any Life Assurance policies you may have.
You also need to consider the storage of your Will and other valuable documents.
